Amberfield is a community developed
by Milton & Ryan Homes, with common areas, mutually-owned and
governed by the owners of the 394 unit townhouses.
Association membership is a relative new property right which,
in effect, combines two elder forms of ownership. The
Association homeowner is (1) the sole owner of the portion of a
building which comprises his/her living quarters and (2) one of
many mutual owners of common areas which the homeowners may use
and enjoy along with other mutual owners.
Each individual homeowner has an
“undivided interest” in the common areas. This means that all
homeowners have a share in the ownership of common areas. An
undivided interest gives the association homeowner the right to
share in the control of all common
areas, but he/she must also pay his/her share of the normal
expenses of operating and maintaining the common areas.
The Amberfield Homeowner Association
was created on June 20, 1984 and follows a specific set of
Articles of Incorporation, Bylaws, as amended, and Declaration
of Covenants, Conditions and Restrictions, as
amended, and other guidelines adopted
by the board of Directors (hereinafter collectively referred to
as “governing guidelines”). - Each new homeowner is entitled to
a copy of these documents from the developer and/or settlement
attorney or previous homeowner upon purchase of a home. You are
advised to read the governing guidelines if you are a homeowner
or a renter, because in either case you are obligated by these
documents.
Homeowners Association
The Amberfield Homeowners
Association is composed of every homeowner of record in
Amberfield. The Annual Meeting of
the Association is held in October. The Board of Directors
hold a monthly meeting on the third
Thursday of each month. Special meetings are held periodically
to discuss issues of general or particular interest to the
community Special meetings are
called by the President of the Board or by a petition signed by
thirty-five percent (35%) of the homeowners.
The Board of Directors is elected at the Annual Meeting. Members
are elected for three year terms: unexpired terms may he
filled by Board appointment until the
Annual Meeting at which time the remaining term will be filled
by election. The Board is composed of seven (7) members. The
Board elects its officers, which mush consist off a President,
Vice President, Secretary and Treasurer (By-law, Pages 10-11)

The duties of the Board, in brief, are (By-laws, Pages
8-10):
a. Care and upkeep of the Association, common areas and
community facilities;
b Establishment, collection and enforcement of assessment of the
members;
c. Hiring and dismissal of personnel to maintain the
Association;
d. Promulgation and enforcement of rules and regulations
respecting the use, occupancy and maintenance of the
Association
e. Authorization of
refunds from excess receipts;
f. Employment of the Management Agent;
g. Election of Officers of the Homeowners Association,
and
h. Other proper business set out in the By-laws.
The Board employs a Management Agent
for the operation and maintenance of the Association. The
responsibilities of the Management Agent are spelled
Out in a contract between the
Association and the Management Agent.
A committee structure has been established by the Board to
assist in the administration of the
Amberfield community. All homeowners are encouraged to
participate on the Committees to improve and maintain our
community standards. Committee participation also provides
residents with a voice in the administration and management of
the community.
